§ 1 validity of the general conditions
These general terms and conditions apply to all contracts concluded by Louis Belgium. Louis Belgium covers all departments and business units as well as all related legal entities with which it cooperates in any way. Any provisions deviating from these general terms and conditions are only valid if explicitly stated in writing by Louis Belgium. Despite the deviating provisions, the remaining provisions remain in full force. Louis Belgium reserves the right to change these terms and conditions at any time. Should one of the provisions of these General Terms and Conditions be or become null and void, the other provisions will remain in full force.
By placing an order the buyer agrees to these general conditions.
§ 2 close sale
2.1 All prices (outside Belgium) include VAT and other price components.
2.2 The presentation of the products in the online store does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the “Buy” button or by ordering from one of our agents, you place a binding order for the goods in the shopping cart or the order form and declare it binding to purchase the ordered goods. The confirmation of receipt of your order is done together with the acceptance of the order immediately after sending your order via an automated e-mail. With this e-mail confirmation the purchase contract has been concluded.
2.3 If an agreement has been concluded and ordered articles are not available within the foreseeable future, both parties have the right to revoke these articles. As soon as we recognize this, we will immediately inform you about the unavailability of the ordered items.
2.4 Your orders are kept with us after the conclusion of the contract. For this purpose, it is necessary that your personal order details for processing the purchase contract in a customer account are registered with us. This happens as soon as one of our agents has entered your address details and you have accepted our general terms and conditions and the privacy policy. If you lose the documents from your orders, please contact us by e-mail / telephone. We will be pleased to send you a copy of the details of your order.

2.5 You agree that you will only receive invoices electronically.
§ 3 Reservation of ownership
3.1 The goods remain our property until full payment.
3.2 The seller has the right to withdraw from the contract in case of breach of contract by the customer, in particular in case of non-payment or in case of violation of an obligation under Article 3.1, and to issue the to demand goods.
§ 4 delivery and shipment
4.1 If available, the goods will be sent by Louis Belgium as soon as possible. Delivery within 2-3 working days. If an article is not in stock, Louis Belgium will deliver within the availability of the manufacturer as soon as possible.
4.2 In the event of a delay in the delivery, we will immediately inform you of this. If you withdraw from the order for this reason, we will immediately cancel your order.
4.3 If not all ordered items are in stock, the buyer is entitled to a partial delivery, insofar as this is reasonable for the buyer.
4.4 Shipping costs for orders within and outside Europe will be charged. For orders within Europe, shipping costs of € 5 will be charged.
4.5 In the event that goods are bought and executed by a customer located outside the European Union, we can unfortunately not offer VAT refunds.
§ 5 Legal right of withdrawal
5.1 Right of withdrawal
You have the right to cancel your order within fourteen days without giving any reason.
The notice period is fourteen days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the goods. If you have ordered several goods together and these are delivered separately, the notice period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.

By means of a clear statement (such as a letter sent by mail or e-mail) about your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not mandatory.
To maintain the cancellation period, it is sufficient that you send notification of the exercise of the right of withdrawal before the expiration of the withdrawal period.
5.2 Consequences of the withdrawal
If you cancel this order, we will reimburse all payments we have received from you, including shipping costs, without undue delay and no later than fourteen days after the date on which we received a notification that you have cancelled this order. For this refund we use the same payment method that you used in the original transaction, unless otherwise agreed with you; In no case will these costs be charged for reimbursement. We can refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.
You must return the goods to us immediately and in any case no later than fourteen days from the date on which you inform us of the cancellation of this order. The deadline is met if you send the goods before the deadline of fourteen days. We do not bear the costs of returning the goods

§ 6 money-back guarantee
6.1 The right of return applies to all goods, provided that the goods are in unused and undamaged condition.
6.2 We will use the same payment method as you used for the original transaction unless otherwise agreed with you.
§ 7 Warranty
7.1 The legal guarantee obligation applies to goods delivered with a term of 2 years.
7.2 If the delivery item is defective or damaged within the warranty period due to manufacturing or material defects, Louis Belgium will deliver or replace a new pair of glasses when it is no longer available. This only applies if the purchase is made within the warranty period of 2 years and with the original purchase receipt from the customer. Without this proof Louis Belgium has the right to reject a warranty claim.
7.3 Obvious defects must be reported to the seller as soon as possible after discovery to prevent further deterioration of the product. Failure to report defects on time does not affect the scope of the seller’s existing warranty obligation. The defective items are returned to Louis Belgium for inspection in the condition they were in at the time the defect was discovered.
7.3 Warranty claims are only applicable if a proof of purchase has been submitted and it can be demonstrated that the damage in question is due to a production / quality error.
The following claims are not considered as a guarantee;
– Paint defects caused by drops or bumps:
For metal glasses there is a real color defect only when the paint is peeling off. Pieces of paint coming from the glasses due to falling and impact are not considered a material defect, but as; self-inflicted.
– Cracks or breakage:
Broken glasses are not considered as a guarantee. We then speak of middle fractures, cracks or breaks.
– Defect during assembly
If a defect occurs during assembly and the above options do not apply. Will the course of action be investigated and then a decision for the right to guarantee.
– If these items do not give you an answer, you can send it as a guarantee or you will be asked to contact the agent in your area or our customer service.
7.5 Insofar as the seller gives guarantees to the buyer, in particular for special promotions, the legal guarantee provisions of Louis Belgium remain in full force.
§ 8 payment
8.1 The customer has the right to choose between the following payment methods:
– Purchase on account: payment term 30 days
– SEPA mandate
– Credit card
8.2 The amount due is due immediately upon delivery, unless otherwise agreed. When an invoice is sent, a payment term of 30 days from the invoice date applies. If the payment is not made within the aforementioned period, there will be an annual interest of 10% on the invoice amount, starting with the expiry date, by law and without any notice of default being required. If an invoice is not paid on the due date, the amount is also increased by 10%. If the delivery does not match the order, the invoice must be paid in full. The missing goods are delivered as quickly as possible.
§ 9 Special information for the order option “frames for showing”
9.1 When placing a show, order, the goods intended for sale remain our property and our indirect property. Until the relevant invoice is paid or the goods are returned.
9.2 You can try and view the versions within 14 days after receiving the show order. The period of 14 days begins with the receipt of ordered goods to view. Before the day of the deadline, the day of delivery of the goods for return with a courier is decisive for your choice. We do not bear the costs of returning.
9.3 If no return of the goods takes place within the 14-day notice period, this will be regarded as the approval of the ordered goods at sight, so that we will charge you the goods after the 14-day return term and an effective purchase contract for the non- returned glasses come into being.
